State expects Adria Airways bankruptcy


Adria Airways’ fate will be officially known in some 48 hours when the Slovenian Civil Aviation Agency announces whether the carrier’s owners have provided a sustainable long-term restructuring model for the debt-stricken company. If they fail to do so, the airline’s Air Operator’s Certificate will be suspended. Members of an employee committee established to look into rescue initiatives met with the Slovenian Minister for Economic Development and Technology, Zdravko Počivalšek, late last week to present possible options. However, speaking at a press conference today, the Minister noted that bankruptcy seems like the only possible scenario. He added the government was considering establishing a new airline some time in the future which would improve Slovenia’s international connectivity following Adria's collapse, but warned the process would take several months and would require a firm partnership with Lufthansa, as well as political consensus in the country.

Mr Počivalšek said Adria’s collapse would have short-term economic effects, but that other airlines would eventually step in to pick up demand. “Slovenia has tremendous tourist potential and carriers can take advantage of the country's need for air connectivity”, he noted. The Minister previously said the state would not “invest even a single euro” into the company under its existing ownership structure, as he believes the turn-around fund 4K Invest are to blame for the airline’s woes. It is believed Adria would need some 28 million euros to resume most of its operations. The development comes as the Slovenian regulator announced that another one of the carrier's jets, a Bombardier CRJ900 registered S5-AAK, has been repossessed. As a result, the company now has just nine aircraft at its disposal - five CRJs and four Saabs. 

In a Facebook post on Sunday, the Slovenian Prime Minister, Marjan Šarec, said, “Adria Airways was sold because it was in a poor state. It was mismanaged long ago, even by some who today, in the media, suggest some miracle solutions. The state will not give financial assistance to the company under its present ownership in any circumstance because they would throw money away, and the law forbids it. In the past, a lot of money was thrown into the company by the state and eventually it was sold. I dare say that if everyone who managed the company on behalf of the state did their job well, we would not have any problems today”. He added, “Some time ago, I held talks both with the company’s management and pilots. I have to say that I do not trust the management because they would like to make money based on nothing. They obviously see the country as a cash cow, from which they want to milk the last cent and take it to somewhere unknown. Notwithstanding the above, the Government of the Republic of Slovenia and the competent ministries are preparing for the coming period. Either by setting up a new company or by providing connectivity through other carriers. Although we expect difficulties, the goal is certainly to maintain Slovenia's connection to the world, especially for tourism, but we must not neglect the fact that Slovenia will preside over the EU Council in 2021”.

Adria's repossessed aircraft have received new registrations

Adding to Adria’s woes, the Slovenian market inspectorate, which oversees compliance with consumer-protection regulations, has fined the company for advertising and selling tickets for services which were subsequently suspended on September 24. It concluded that the sales amounted to misleading business practice. In her findings, the Slovenian Chief Market Inspector, Andrejka Grlić, said, “Adria Airways‘ management was fully aware that the company would be unable to operate planned flights since they had all available information on the firm’s financial state and available capacities”. Ms Grlić added that the inspectorate was monitoring and investigating other issues at Adria Airways as well. The company has been fined six thousand euros.

Adria operated the first service with its own aircraft and crew last night since September 24. The chartered flight pick-upped the Slovenian Men’s Volleyball Team in Paris who were runners-up at the European Volleyball Championships. However, the flight was fully paid for by a local Slovenian tour operator Palma, while the crew provided their services free of charge.

      I'm not sure that is possible. Slovenia's geographic location and diaspora size doesn't make it feasible for Wizz to base a number of planes and fly to places in Germany and Scandinavia with A320s.

      First of all, all my colleagues were very professional to the very last end. On my flight, they showed great compassion to all passengers affected by delays, cancellations and merged flights.

      However, the general public does not give a "you know what" about the employees of Adria. Everyone is rooting for the bankruptcy. Poor passengers, they will never get their money back. And the employees? Will they ever get their salaries?!

    No new airline construct please, it will fail again, why? To compensate for the relatively high fix costs (airline is small but running an airline is also quite complex and the smaller the airline, the higher the proportion of these costs), you would need larger aircraft, also to be competitive with prices. Now Slovenia is just a 2 mio market and last year only 400K departed on JP ex LJU as O/D passengers, so the market to fill these A320 planes is not there, ergo flights are operated with CR9s or CR7s, also to hve more departure waves a day. And here is JPs problem. Instead of 180 passengers on A320 they fly 86 pax with CR9 with higher ticket prizes, for many Slovenians too high, so they depart fm Graz, Trieste, Venice, Treviso, Bergamo or Zagreb.
    If even the CR9s are not full, u soon become unprofitable

    Thats why it makes no sense to waste any EUR anymore for a new airline construct but to invite LH group airlines to fly to LJU. Same time SLO needs to invest taxpayers money into new hospitals to improve medical care services, new retirement homes and improve public transportation such as tram lines in LJU, S Bahn Network in LJU, new rail and busstation in LJU

      I was already thinking about Dolomiti.

      They are half Italian half German, know the (surrounding) market, are part of LH Group and operate the right metal with 100 seaters, which are not too big for LJU, and should have a smaller cost base compared to e.g. LH Cityline or similar.

      If LH/EN can free up the capacity, they should surely go for LJU and base 3 E190 in Slovenia to operate FRA 4x daily and MUC, VIE, ZRH twice daily each. That would seem logical, perfect and suitable capacity and LH could secure the market.

      @anon 9:48: well if we stretch the question into the legal sphere and assume that the management will even act upon it, then techically if they don't show up and/or don't follow the employer's orders for work they can get fired with no notice period and they are not eligible for unemployment benefits at the unemployment office. So it's not the one missed salary, but a potential max. 25 months of unemployment benefits question.

      the flying personnel has more options, but the ground crews are on thin ice, but could halt the company also. it's not only the pilots. But if the didn't show up, management or some supplier would probably file for bankruptcy the same day. Or in this case at hand wait until wednesday and the CAA would revoke them anyway so the bankruptcy motion would go on thursday.

      But as things go and are "heard on the streets" the employees are pubshing through the political parties (SD and The Left) to be back on the state t**ty. And the politician just love to flock around other people's money. So we'll see today what the governemt plans to do.

      @Q400: I think Finance newspaper reported that previously one hangar that was left was a collateral for Petrol. Now that the hangar was transfered to ADria Tehnika as payment in kind, Petrol demands upfront payment and is refusing to give JP any credit line. This is how it was reported. If it is 100% true, I don't know.

    I highly doubt LJU airport will recover soon with the disappearance of JP. Slovenia is just not the market for Wizz for example and many airlines in Europe are struggling itself currently, opening new routes to LJU won't be their priority. Slovenia is just too small and surrounded by many other airports like Zagreb, Rijeka(from march to october), Pula (march to october).
    Venice Treviso and Venice airport, Trieste. And even Vienna & Budapest are not that far.
    Besides that for many people that are not from LJU itself like Maribor & Celje its even closer to drive to Zag, and those people don't take Bregana - Obrezje border so they dont wait that long.

    Therefore if they want to keep LJU the size as it is today they should save JP if not I fear that they don't need to build the new terminal anytime soon.

      VIE and BUD are too far from LJU. It's cca 4 hours driving. PUY and RJK are quite small and the road connections are not great.

      For serious (ie frequent and reliable) busines connections realistically only ZAG and TRS are useful. VCE possibly for the extreme west of Slovenia.

      The real problem for wizz starting LJU is the lack of a gasto market. Which ist itself good for Slovenia, as people are not emigrating in masses as they do in other EE countries.
      Tourism itself can hardly sustain year round routes. You need a mix of everything. Wizz is often used by business especially on routes with more frequences.

      Slovenia will lose also the connections to transfer destinations such as SKP, SOF, PRN

      At the end, it will be mostly WE hubs, sadly

      Personally witnessed quite large number of LJ car plates (and KP and others as well) at RJK. And you are not right about "not great road connections". The part from Ljubljana to Postojna is highway. The part from the border till Krk Bridge (basically RJK airport) is highway as well. The only part which is not highway is Postojna-Pivka-Ilirska Bistrica, around 30 km, and that road, despite some curves and up downs is decent as well. The bus makes it in 2 hours, I drive it in 1h30 - 1h40. That much from me.

      The news conference just ended with Minister of commerce of SI. It looks like Adria is in the last seconds of the flat spin towards chapter 11. Government will not invest a cent, not just due to 4K ownership but also due to screaming read figures. Two possible scenarios after flat spin ends.. 1st they will let carriers to grab whatever slots/lines they see fit.. 2nd they (government) will consider founding a new national carrier (allied with LH)... both scenarios will take months to realize. That is it..

      no chapter 11. in european-continental legal terms that is more akin to the compulsory settlement (business restructuring), which generally in EU states you cannot really do in practice.

      What the minister is saying is chapter 7 of US bankruptcy code - straightforward standard bankruptcy.


      just speaking legal for our non-lawyer members here to clear things: under EASA you cannot have AoC if you are deemed insolvent. And as long as the insolvency state is ongoing you cannot have AoC. But with chapter 11 you are technically insolvent but need cash-flow to cover the agreed debt. So it is cancelling one another out. You're insolvent, but have to fly to gain cash to pay the settlement, but you cannot fly because you can't have AoC if you're not solvent.

      That was basically the overwhelming practice in European states. That's why every insolvency basically ended with classic bankruptcy proceedings.

    I do have to say, that this is one of the few times I've been convinced in the wisdom and fairness towards the taxpayers form my government. Well done, you've gained points in my book. On that front at least. Let's hope that the new airline they are pushing towards, will not be a total and complete waste of money on account of rampant corruption and nepotism, that is usual when in to comes to government owned companies here. In the end I do not really care if they will make a loss year after year, if the company will at least be frugal and run well enough, without the usual balkan business shadiness.

    The most important things said by minister for economical affairs:
    - 4K is irresponsible owner and there was mismanagement
    - state will not lend money or cooperate with current Adria
    - state will not buy or overtake Adria from 4K, becuase 4K in this case will not be responsible anymore for situation
    - there are two options for future:
    A. leave everything to the market
    B. established a new airline
    - they are in close contacts with Luft Hansa

    It will be a pain in the arse for the pilots. Wihout Adria, commuting will be almost impossible. The only solution is to relocate the family, send kids to school elsewhere and pray to whomever that the new company doesn't close the base. Like Ryanair has a habit of doing. Huge problem!!

      Losing a job is always a pain in the arse. That's part of the reason why we have social benefits. Throwing huge sums of money (eg. 100 million EUR) away, just so a couple of hundred of well educated people, with good potential to find another job, can keep doing what' they've been doing.. just does not seem right, right?

      because in this instance i know some figures and facts from my job, i'll share it with you:

      actually a lot of Mura employees are still on the social welfare benefits... too old and without any skill ( alot of them had only elementary school an/or 2 years of textile high school). and no, the whole textile industry collapsed so only a minority got jobs in the same industry. A lot of them went to Austria to work in the leather factories, some who had experience of working on farm went to work for agrucultural companies (also primarily in austria). It is actually confirmed data that in the belt from Maribor, Murska Sobota and to the north, about 8.000 - 10.000 are employed in Austria.

      As for the construction workers the majority of engineers opened their own engineering frms and vegetated for some year, quite a lot of them went to Austria. The workers mainly went to the north - austria, germany, etc. Other firms did not hire that much, because they were all barely staying above water, because there were not enough projects in the crisis.

      You just proved my point. You have NO idea about aviation. I guess those Mura workers are also very afraid to be based somewhere else in case their new employer determines that sewing machines will be better employed in Spain or France.

    but now that the government has spoken, maybe the employees will pich in and buy the company for 1 EUR, and then we will see how profitable they will become. I'll make a prediction that they will kill eachother at the very basic question who shall be named the CEO and which cost can be reduced. That is usually the case with "samoupravljanje"....in practice it means CSIT - controlled samoupravljanje into terrain

    WHAT!!!!! It would REQUIRE a FIRM partnership with LH???? Who on Earth could REQUIRE that from a government of Slovenia? Does Lufthansa own the country of Slovenia so they can force it?

    There is no reason for ANY kind of partnership with LH. Let LH group fly their own planes from their hubs to LJU, just like Air France, Air Serbia, Aeroflot, Turkish and others do right now.

    As if there was not enough pointers so far indicating LH interests are possibly behind 4K and destruction of Adria. If there is any chance for any new airline in Slo, it should stay away as far as possible from LH and Star Alliance.
